Kota Kinabalu: Two policemen were freed from a charge of receiving bribe of RM300, without their defence being called.

Sessions Court Judge Jason Juga discharged and acquitted Lance Corporal Mohd Faizal Nor, 34, and Corporal Alzohari Md Suhaili, 47, after ruling that the prosecution had failed to establish a prima facie case against them.

They were accused of accepting the bribe from one Muhammad Elham Ahmad as an inducement to not take action on Muhammad who has no valid identification document.

The crime allegedly took place between 1pm and 3.50pm on July 4, 2016 in front of the Oceanus Waterfront Mall building, here.

The were jointly charged under Section 17(a) of the Malaysian Anti-Corruption Commission (MACC) Act 2009 provides for a jail term of up to 20 years and a fine of not less than five times the amount of bribe received or RM10,000, whichever is higher, on conviction.

The court ordered for the sum of bail to be refunded to the duo.

The prosecution had called 14 witnesses during the hearing.

Prosecuting Officer Norsham Saharom from MACC appeared for the prosecution while the duo was represented by counsel Nurshalilah Fauzan Mailin.
