Trafficking drugs: Indonesian jailed, local man freed

TAWAU: An Indonesian man was sentenced to life imprisonment and ordered to get 12 strokes of the cane for trafficking 17,656.9g of syabu while a local man, who was jointly charged with him, was freed of the charge.High Court Judge Dr Lim Hock Leng, in delivering his decision on Tuesday, sentenced the first accused, Saripuddin Sappe, to life imprisonment and ordered him to be caned 12 times.

The court ordered Saripuddin, 43, to serve the sentence from the date of his arrest on Jan 14, 2021 and ordered him to be referred to the Immigration Department thereafter.
The second accused, Yusuf Padu, 58, who was defended by counsels Ram Singh, Kamarudin Mohd Chinki, Kimberly Ye and Chen Wen Jye, was acquitted and discharged.
Yusof was in tears when the judge announced the decision while his family, present in court, also broke down in tears and proceeded to hug the counsel after the proceedings.

The charge, under Section 39B(1)(a) of the Dangerous Drugs Act 1952, carries a punishment of either the death penalty or life in prison and whipping with a minimum of 15 strokes.
Saripuddin and Yusuf gave evidence under oath and were the sole witness in their defence, respectively.

The prosecution had called six
witnesses to testify at the prosecution stage.
Deputy Public Prosecutor Hurman Hussain prosecuted while Saripuddin was represented by counsel Abdul Ghani Zelika and Darmin Acho.
