Indonesian fined over careless driving: Court
Syahriel was charged under Section 43(1) of the Road Transport Act 1987 (Amended 1999) which carries a fine of between RM5,000 and RM10,000 and liable to jail of up to 12 months, on conviction.
Kota Kinabalu: An Indonesian motorist was fined RM6,000 or four months jail by the Traffic Court  for careless and inconsiderate driving which resulted in an accident involving a pedestrian two years ago.

Syahriel Raja Buan, 48, pleaded guilty before Magistrate Lovely Natasha Charles to committing the offence to Maria Jari while driving a Proton Saga at Taman Layang-Layang, here, at 10.30am on Aug 2, 2021.

The court was informed hat the accident occurred due to Syahriel’s carelessness while driving the car because when he arrived in front of a house at Lorong Zirafah 6, he did not notice that the gear of his vehicle was still in ‘D’ mode and the handbrake was not pulled properly.

The car move slowly forward and crashed into the iron fence and Maria who was standing behind the fence at that time, said the prosecution.

The victim suffered severe injuries due to the accident and was rushed to the  hospital for further treatment, the court heard.

Syahriel was charged under Section 43(1) of the Road Transport Act 1987 (Amended 1999) which carries a fine of between RM5,000 and RM10,000 and liable to jail of up to 12 months, on conviction.

The court also ordered Syahriel’s driving licence to be endorsed with the conviction.

Meanwhile, another motorist was fined RM2,000 or two months jail for causing danger to another road user.

Md Faizul Abd Muis, 35, admitted to committing the offence to motorcyclist  Faizal Saimin at 9am on Oct 28, 2021 at Jalan Kepayan, on the KKIA 1 flyover here.

According to the prosecution, police investigation found that Faizul, who drove a four-wheel drive and was from Papar direction towards the city, had immediately stopped the vehicle on the left lane of the flyover as the steering wheel was shaking.

The facts of the case stated that Faizul did not place a triangle warning sign and did not park outside the road or emergency lane, causing a motorcycle to hit his vehicle.

The motorcyclist was thrown into the middle of the road and was hit by a moving car.

The victim’s left leg was fractured due to the incident and was rushed to the  hospital.

Faizul was charged under Section 48(1) of the Road Transport Act 1987 which provides for a fine of between RM1,000 and RM5,000 or jail term of up to one year or both, on conviction.
