Kota Kinabalu: A 40-year-old man was sentenced to six years’ jail and two strokes of the cane by the Sessions Court here after being found guilty after a full trial on a charge of repeated drug use.
Judge Amir Shah Amir Hassan found Suhaimi Mohammed guilty of taking Syabu and Amphetamine without lawful authority at the Narcotics Criminal Investigation Division office of the police headquarters here, at about 1.40am on Feb 21, 2024.
The charge under Section 15(1)(a) of the Dangerous Drugs Act 1952, read together with Section 39C(1)(b) of the same Act, was framed against Suhaimi as he had two previous convictions under Section 15(1)(a) of the Act.
The offence provides for a jail term between five years and seven years and whipping of not more than three strokes of the cane, on conviction.
The prosecution called six witnesses during the trial while Suhaimi, who was unrepresented, called two defence witnesses.
The court ordered Suhaimi to serve the sentence from the date of his arrest.

In Sandakan, two men were jailed and ordered to get whipping for repeatedly taking syabu.
Idzuan Leong, 25, and Abdul Rape Abdul Hakim, 34, pleaded guilty separately before Sessions Court Judge Roslinda Razali, to the charge against them, on Friday.
Idzuan was jailed five years and 10 months plus a stroke of the cane after found to taking syabu on Feb 6 this year after his urine was tested positive for drug at the police station, here and he has two previous conviction record.
Abdul Rape was sentenced to six years and six months and ordered to be given two strokes of the cane for repeating to take syabu after his urine was tested positive for syabu on Feb 5 at the police station, here.
He has two previous conviction records in 2023 and 2024.
After serving the jail sentence, the duo was ordered placed under police supervision for two years.
Deputy Public Prosecutor Yuvan Bharathan appeared for the prosecution while Idzuan and Abdul Rape were not represented.
