493ha surveyed in Kampung Kiau

Kota Kinabalu: Hajiji told Datuk Ewon Benedick (Kadamaian) the State Government through the Lands and Surveys Department carried out Pantas surveying works in Kg Kiau since 2019 and was completed in February 2024, involving a total of 1,209 lots with area of ​​493.55 hectares.

“The Pantas surveying work in Kg Tambatuon has also been approved and is expected to be completed in December.

“For Kg Sayap, Kg Terintidon, Kg Lobong-Lobong, Kg Kaung, Kg Tombotuan, Kg Malangkap and Kg Lasou, the department will carry out inspections and field investigations to determine whether the Pantas surveying work can be implemented.” 

Until April 2024, the department received an allocation from the Federal Government amounting to RM10 million for Pantas surveying.

On land eviction notices to 43 house owners in Kampung Cenderamata by the Sandakan Assistant Collector of Land Revenue (ACLR) raised by Alias, Hajiji said the actions are the responsibility of the Lands and Surveys Department under the Land Ordinance.

“This includes enforcement on illegal occupation of government land, including reserve land for road construction. The issuance of the notice by the Sandakan ACLR on Feb. 13, 2024, is a preliminary notice (soft notice) to the party believed to be occupying the government-reserve land. 

“This notice is followed up with a final notice and enforcement action in line with the requirements of the Land Ordinance,” he said, adding the State Government is always sensitive and gives priority to gazetting village reserve land and reserve land for settlement.

To a question from Junz Wong (Warisan), Hajiji said the requirement for the provision of open space is under the Town and Country Planning Ordinance Cap.141.

He explained that the open space produced from land development such as housing and others will be handed over or transferred to the Local Authority for the management and maintenance of the open space.

Replying to Jamil Hamzah (Bugaya), Hajiji said the State Government is aware of and understands the concerns regarding the houses in Kg Sungai Nasip that were built in the Class V Semporna Forest Reserve, including the road which is also part of the forest reserve.

He said the Forestry Department has given verbal advice to the encroachers and would conduct a Social Baseline Survey (SBS) to obtain more information about the people living there.

“The Forest Reserve is the right of the State Government as well as the people of Sabah as a whole which needs to be protected according to the law enshrined under the Forest Enactment 1968 which cannot be occupied or inhabited by any party or individual for personal gain. 

“However, if the occupation involves indigenous people who are native to the area, consideration can be made according to the law in force. If it is a new occupation, they should leave so that the forest reserve area is preserved and not invaded arbitrarily.
