35 years, 12 strokes for killing dad
Liew was found guilty of murdering Liew Nyuk Shung, 65, with a machete at 2.30pm, on June 17, 2020, in a house at Kg Bantayan, Tamparuli.
Kota Kinabalu: A 26-year-old unemployed man was on Thursday jailed 35 years and ordered to be given 12 lashes of the cane for murdering his father in Tuaran four years ago.

Judicial Commissioner Amelati Parnell meted out the sentence to Arnold Liew Kim Choi at the end of his defence.

In delivering her ruling, Amelati held that the prosecution had successfully proven its case beyond reasonable doubt while the defence failed to raise reasonable doubts.

Liew was found guilty of murdering Liew Nyuk Shung, 65, with a machete at 2.30pm, on June 17, 2020, in a house at Kg Bantayan, Tamparuli.

He was convicted under Section 302 of the Penal Code which carries a sentence of either the death penalty or imprisonment for not less than 30 years but not exceeding 40 years, and if not sentenced to death, shall be punished with whipping of not less than 12 strokes for male convicts below 50 years of age.

Counsel Ronny Cham during mitigation applied for 30 years imprisonment sentence and submitted, among others, that it was an unfortunate event involving a family member and that Liew was under the influence of drugs at that time.

Deputy Public Prosecutor (DPP) Azreen Yas Mohamad Ramli applied for the death penalty and stressed that the court must give the highest consideration to public interest as it surpasses the accused’s interest.

She also submitted that the defence of being under the influence of drugs was a mere denial, adding that the victim suffered multiple injuries and his right wrist was also amputated.

Twelve prosecution witnesses testified during the prosecution stage while five defence witnesses, including Liew, testified in his defence.

The court ordered Liew to serve the imprisonment sentence from the date of his arrest on June 18, 2020.
