SANDAKAN: Two men were jailed for 15 months by the Magistrate’s Court here, Friday, for giving false information when applying for an identity card for an individual who is not his biological child.

Bakri Sakka, 70, and Hasanuddin Sande, 38, pleaded guilty separately before Magistrate Nur Faezah Jafry and Magistrate Mohammad Azeem Mohd Ridzo.

Bakri was jailed for three months and fined RM5,000, or five months jail, for committing the offence on Sept 20 2022, at Meeting Room, 1st Floor Wisma Federation, here at 4.39pm.

Hasanuddin was jailed for 12 months and fined RM7,500,  or six months, for committing the offence at the same location, date and time.

Bakri and Hasanuddin were charged under Section 25(1)(b) of the National Registration Regulation, which provides for a jail term of up to three years or a fine, on conviction.

NRD Prosecuting Officer Mohd Naser Mohd Nadzeri applied for a preventive sentence.

Naser said this is to give awareness to the community, where identification document issue is very serious in addition to being sensitive and involving national sovereignty.

He said the acts of the two accused, for making an identity card application in 2022 for an impersonator who is not his biological child, especially for someone who is not a citizen, using the birth register belonging to a citizen so that an identity card was almost issued to the impersonator, is an offence that needs to be taken seriously.

“If the impersonator succeeds in obtaining an identity card, he will also get all the facilities and advantages as a citizen, even though this impersonator is not eligible,” Naser said.

Counsel Mohd Nazri Zikiri, representing Bakri, requested a lenient sentence as Bakri is an elderly while Hasanuddin was unrepresented.

Bakri and Hasanuddin were ordered to serve the sentence from the date of their arrest.

The court ordered Hasanuddin to be referred to the immigration department after serving the sentence.
