Filipino gets 12 years and rotan for molesting 11-year-old

According to the fact of the case, the accused was arrested at 3am by a team from the Bum Bum police station after the girl’s father, 62, lodged a report.
TAWAU: A jobless Filipino was jailed for 12 years and given six strokes of the rotan by the Sessions Court, Wednesday, for sexually assaulting an 11-year-old girl last year.The court also ordered him to be referred to the Immigration Department and deported to his country of origin after serving his sentence.

Anuar Mohd Khamka, 22, pleaded guilty before Judge Awang Kerisnada Awang Mahmud to committing the offence in a bush at Kampung Balimbang, Pulau Bum Bum, Semporna around 12.30am on Feb 4, 2021.
According to the fact of the case, the accused was arrested at 3am by a team from the Bum Bum police station after the girl’s father, 62, lodged a report.
Investigation showed that the girl went out to buy something near her house at around midnight when the accused saw her and asked her to follow him.
The accused then brought her to a bush near the village’s bridge and started his sexual assault against her while covering her mouth.

Her elder sister who realised that she was missing from the house went out looking for her accompanied by another sibling.
A dog bark led them to the bush and upon seeing them, the accused fled.

Kerisnada said after considering the facts of the case, he had to pass a heavy sentence to serve as a deterrent to others and also to protect the girl.
The accused was charged under Section 14(d) of the Sexual Offence Against Children Act 2017 which carries a jail sentence not exceeding 20 years or fine or stroke of the rotan or any two of the sentences, if found guilty.
Prosecution was done by DPP Mohd Suhaimi Suriana while the accused was not represented.
