PETALING JAYA: Two Sabah representatives will move a motion to revoke the Petronas agreement, which is part of the Petroleum Development Act (PDA) 1974, in the upcoming sitting of the state assembly.

Kadamaian assemblyman Ewon Benedick and Luyang assemblyman Phoong Jin Zhe said they would move the motion during the sitting on July 18 and 21.

“We are of the view that all laws passed in Parliament relating to the rights and interests of Sabah, as stated in the Malaysia Agreement 1963, must first be passed in the state assembly before being enforced.

“If it is not approved in the state assembly, then the Act should not be enforced in Sabah,” they said in a joint statement.

The PDA led to the formation of Petronas. It states that the company is the regulator of all oil and gas assets in the country.

Ewon and Phoong said the agreement was a “big mistake” and the state’s representatives who allowed the agreement to pass should be held accountable.

“Sabah needs strong leaders who are not easily bullied by the federal government and its demands, which only benefit Putrajaya,” they said.

They added that if they were unsuccessful in getting the agreement revoked, they would consider submitting an application for a judicial review to challenge the PDA.

Ewon and Phoong previously called on former Sabah chief ministers Harris Salleh and Joseph Pairin Kitingan to explain why they signed an agreement with the federal government that led to the PDA.

Harris was reported as saying that the Petronas agreement was signed to comply with the PDA after it was passed in Parliament. He said that Sabah’s state representatives supported the decision at the time and challenged Ewon and Phoong to move a motion to revoke it.
