Hiring Filipina illegals: Duo fined

Kota Kinabalu: A man and a woman were fined a total of RM40,000 respectively for hiring illegal immigrants.Subhan Khursheed, 50, and Loyola Jubun, 39, pleaded guilty separately before Sessions Court Judge Azreena Aziz, to the charge against them on Tuesday.

Subhan was fined RM10,000 or two months’ jail for each illegal involved in which he had employed two Filipinas, aged 46 and 36, at 10.15am on Oct 20 this year at the Kaliwal Enterprise Kedai No3 in Jalan Haiwan, Likas, here.
The court ordered Subhan to pay RM10,000 on Wednesday while the balance of RM10,000 must be paid by or before Jan 31, next year.
Meanwhile, Loyola was ordered to pay RM10,00 in default two months’ jail for hiring two Indonesians, aged 39 and 20, and both of the Indonesians did not have any document.
She committed the offence at 10am on Oct 19, this year at the The Canteen Jalan Masjid Lama, Ranau.

Loyola granted her application to pay the in three times instalments in which on Tuesday she must pay RM5,000, and another RM10,000 on or before Jan 31 next year, with the last payment of RM5,000 on or before Feb 21 next year.
The duo had committed the offence under Section 55B of the Immigration Act 1959/63 which carries a jail term of to a year, or a fine of between RM10,000 and RM50,000, or both, for each illegal immigrant involved. In mitigation, the duo asked for leniency saying that due to the pandemic their income was affected.

However, Prosecuting Officer Zaifee Zaimin from the Immigration Department urged the court to impose an adequate sentence as such case were rampant nowadays.
