Four fined for gathering at cafe
Kota Kinabalu: Four people were fined a total of RM6,000 by the Magistrate’s Court here for failing to observe the Movement Control Order (MCO) 3.0 by gathering at a café here.They are Jeffendy Udi, 29, a Malaysian, and three foreigners: Medzrifa Muhaimin, 29, Arner Gaffar, 25 and Ziana Sani, 25. They were fined RM1,500 each or seven days’ jail.

Jeffendy admitted to committing the offence at 1.30am on June 13 at the Bee Kim Regal Cafè in Harbour City, Sembulan.

The facts of the case stated that a police team went to the cafè for inspection and found the group inside a room.

They were sitting on the sofa without social distancing. There was alcohol on the table and they had not scanned the MySejahtera QR code.

Magistrate Jessica Ombou Kakayun convicted them under Rule 17(1) of the Prevention and Control of Infectious Diseases (Measures within the Infected Local Areas) Regulations 2021, read together with Section 34 of the Penal Code, which carries a fine of up to RM50,000 or up to six months’ jail, or both, on conviction.

Duty counsel Lim Ming Zoong @ Lawrence, representing Jeffendy, requested for a lenient sentence on the grounds that he was remorseful and that it was his first offence.

The other three, who were unrepresented, also requested for leniency.

Inspector Albert Basiri prosecuted.
