German charged with assaulting man

Kota Kinabalu: A 59-year-old German was charged in the Magistrate’s Court with assaulting a man four years ago.

Thomas Rainer Vogel, a bakery owner, pleaded not guilty before Magistrate Lovely Natasha Charles to voluntarily causing hurt to one Daniel Liew Vun Tshun at 9am on June 6, 2016 at Jalan Mawas in Luyang.

Inspector Albert Basiri, prosecuting, in applying for a case management, proposed bail at RM3,000 in two sureties.

Vogel, who was unrepresented, applied for a lower bail on the grounds that he have been in the State for 12 years and have a family here. He said that he has a bakery business in Donggongon but that he is facing some financial difficulty due to the Covid-19 pandemic.

Lovely set Aug 12 for case management and offered Vogel bail at RM2,000 in two sureties and also ordered his passport to be kept by the court.

The charge under Section 323 of the Penal Code carries a jail term of up to a year or fine of up to RM2,000 or both on conviction.

In another case, a 48-year-old man was jailed two days and fined a total of RM75 on three counts of uttering abusive words towards his cousin, uncle and policeman in Penampang.

Terence John, who was brought before Magistrates Stephanie Sherron Abbie and Afiq Agoes, admitted to committing the offence to Casey Bryen, Michael J and Corporal Juwahir Norjai’ai at 9pm on July 8 in a house at Kg Kobusak, Nosoob.

Terence was ordered by Magistrate Afiq to serve two days in jail effectively from Wednesday and was also fined RM25 or one week jail for committing the offence to Michael.

Magistrate Stephanie ordered Terence to pay RM25 fine or a day jail each for committing the offence to Casey and Juwahir.

The prosecution in tendering the facts of the case, informed the court that on the said day, Terence went berserk as he was upset with Casey for disturbing his sleep by playing video games at the living room next to his bedroom on the night before the incident.

An argument later ensued between Terence and Casey in which Terence then uttered the abusive word toward Casey and Michael, who wanted to calm them and later to the policeman who was contacted following a quarrel in the said house.

Police arrested Terence at 10.52pm the same day following a report lodged against him by the victims as they feared of their safety.

Each charge under Section 8 (1) of the Minor Offence Ordinance provides for a fine of RM25 or jail term of up to one week.

Duty counsel Lim Ming Zoong @ Lawrence, representing Terence requested for a lenient sentence on the grounds among others that he was unemployed and that he has a family to support.

Inspectors Suzie @ Stephanie Kupit and Lim Swee Beng appeared for prosecution.
