Using fake bank statements: Man jailed, fined
Kota Kinabalu: A 60-year-old man was jailed a total of nine days and fined RM9,000 for using fake bank statements to get tender for supplying cooked food to a hostel of a primary school in Ranau.

Kohadie Watiman pleaded guilty before Sessions Court Judge Abu Bakar Manat to all charges against him on Friday.

Kohadie was sentenced to three days and fined RM3,000 or three months’ jail for each count but the court ordered him to serve the jail sentence concurrently from Friday.

On the first to third counts, Kohadie as an individual who operate the Syarikat Terbilang Enterprise had used three fake banks statements of the company dated July 31, Aug 31 and Sept 30, 2016 for the purpose to obtain the tender to supply cooked food for the hostel of SK Karagasan.

He committed the offence at the State Education Department here on Nov 24, 2016.

The offence, under Section 471 of the Penal Code and punishable under Section 465 of the same Code, carries a jail term of up to two years or a fine, or both, on conviction.

During mitigation, Kohadie who was not represented asked for leniency saying that he had given full cooperation throughout the investigation and very remorseful of his wrongdoing.

He informed the court that he has his six children who also suffered due to his wrongdoing.

However, Prosecuting Officer, Mohd Faliq Basiruddin from the Malaysian Anti-Corruption Commission (MACC) urged the court to impose a deterrent sentence due to the seriousness of the offence as well as to give a message to the would-be offender.

The court heard that the company, operated by Kohadie, was registered under the name of Kohadie’s daughter and Kohadie had known about the tender through a newspaper. He then attended the tender briefing at SMK Bandaraya, here, before purchasing the tender form at the State Education Department for RM300.

Kohaide then completed the tender form using the details of the company where he applied for the tender to supply cooked food to SK Karagasan hostel for the period of March 1, 2017 to February 28, 2019.

Before submitting the form, in November, Kohadie had met a man to ask for a bank statement on behalf of the said company for July 2016, August 2016 and September 2016 and requested the man to change the balance of the transactions in the statement to the amount of up to thousands ringgit. The bank statement was later filed with the tender application form which was later sent to the State Education Department.

In early 2017, the company was selected to supply cooked food for SK Karagasan hostel valued RM950,820.

On Jan 14 last year, Kohadie was arrested for using forged documents for his application form.
