Pakistani fined RM4,000 under Poisons Act

KOTA KINABALU: A 48-year-old Pakistani trader was fined a total of RM4,000 by the Sessions Court on two counts of illegally having medicinal products containing poison and selling them.Fazir Karim Awan Dal who holds a valid MyKad admitted before Judge Ainul Shahrin Mohamad to committing the offences at 10.20am on May 12, this year at Mohsen Khan Trading, at Block G, Inanam Business Centre here.He was ordered to pay a fine of RM2,000 or 14 days for selling a packet of Novomin (ten tablets) found containing Diphenhydramine, a poison listed in the First Schedule of the Poisons Act 1952 to a customer through his worker.ADVERTISEMENT The charge under Section 13(a) of the Poison Act 1952 (revised 1989) is punishable under Section 32(2) of the same Act which provides for a fine of up to RM3,000 or up to one year jail or both on conviction.Fazir on the second count, was fined another RM2,000 or 14 days' jail for having 19 boxes of Novomin (190 tablets) without a licence issued under the Poison Act 1952.Fazir, who was not represented, requested for leniency saying he has two wives with 13 children.He also said that his three shops in Menggatal were recently destroyed by fire and that he owed a lot of companies.ADVERTISEMENT Prosecuting officer Raja Nurul Fatin Raja Kamarulzaman of the Pharmacy Enforcement Unit under the Health Department urged the court to impose a deterrent sentence to safeguard the public's health, and as a lesson to Fazir as well as a warning to would-be offenders.Raja Nurul said the seized product was medicine to treat dizziness or nausea which could only be sold on prescription by doctors or licensed pharmacists and that the selling of such medicine by someone who has no knowledge on it could bring severe consequence to customers.
