Fined RM4m over Mara auto deals
KOTA KINABALU: A 40-year-old car salesman was jailed six months and fined a total of RM4 million for submitting false claims pertaining to the purchase of seven vehicles for Giatmara valued at RM776,400.

 Sessions Court Judge Abu Bakar Manaf handed the sentence to Ezwan Shah Jaafar after he changed his plea and admitted to two alternative charges.

 On the first count, Ezwan was sentenced to six months’ jail and fined RM2.3 million or six months’ jail for submitting four false invoices for the purchase of four vehicles valued at RM449,300 to Giatmara Sdn Bhd Chief Executive Officer Meriyam Abd Majid.

 The offence took place at the 7th floor of Wisma SESB in Jalan Tunku Abdul Rahman between Aug. 1 and 31, 2012.

 On the second count, he was jailed six months and fined RM1.7million or four months’ jail for submitting another three false invoices for the purchase of another three vehicles valued RM327,100, to Giatmara Sdn Bhd Deputy Chief Executive Officer Mohamed Roseli Dol.  He committed the offence at the same place between June 1 and July 31, 2013.

 The offence under Section 18 of the Malaysian Anti-Corruption Commission (MACC) Act 2009 provides for a jail term of up to 20 years and a fine of not less than five times the amount of the false details, or RM10,000, whichever is higher.

 The court ordered Ezwan to serve sentence from the date of his conviction which was on Monday.

During mitigation, counsel Rebecca Taimin together with counsel Razali Awang who defended Ezwan, asked for a bond of good behaviour to be imposed on their client saying it was very difficult for his wife to take care of his children and that she would give birth to another on Jan. 19 this year.

 Ezwan also told the court that he was very remorseful and promised to not repeat the offence.

 However, Malaysian Anti-Corruption Commission Prosecuting Officer Awang Shamsul Baharom Bongsu appeared for the prosecution urged the court to hand down a deterrent sentence on the grounds that Giatmara suffered a huge loss due to Ezwan.

 Awang also submitted that the public interest should be considered in handing down sentence. - Cynthia D Baga
