Anifah bid to strike out election petition

Kota Kinabalu: Former Foreign Minister Datuk Seri Anifah Aman is expected to file a preliminary objection to strike out the election petition filed by Parti Warisan Sabah (Warisan) to nullify his victory in the Kimanis parliamentary seat in the recent general election.Anifah, the returning officer and Election Commission were named as the first, second and third respondent, respectively in the election petition filed by Warisan's Kimanis candidate Datuk Karim Bujang.

Karim is seeking that Anifah was not duly elected as the Member of Parliament and that it be declared that the said election held on May 9 is void.

On Tuesday, Election Court Judge Supang Lian during mention of the petition in chamber, was informed of the respondents' indication that they would be raising a preliminary objection to strike out the election petition.

She directed the respondents to file and serve their preliminary objection seven days from Tuesday i.e. by Aug 21, failing which they will be taken to waive the right to file such application.

Supang also set dates for parties to exchange submissions and fixed Sept 20 for hearing of the preliminary objection.

Earlier, the court fixed Sept 14 for decision of the petitioner's amendment application of the election petition to include further allegation of illegal practice and another application for recovery of further documents.

The petitioner is represented by counsels Raymond Szetu, Song Wei Wan, Tiong Jia Yi, Thong Fei Eng and Chua Kuan E while the first respondent is represented by counsel Tengku Fuad Tengku Ahmad and Ridwandean Borhan.

The second and third respondents were represented by counsel Japar Estaban, Muammar Julkarnain, Faizal Sarbi and Abdul Fikri Abdullah.

Meanwhile, Kiulu assemblyman Datuk Joniston Bangkuai is also expected to file a preliminary objection to strike out the election petition filed against him by Warisan's Kiulu candidate Jo-Anna Sue Henley Rampas.

Supang has directed the respondents to file and serve their respective preliminary objection seven days from Tuesday by August 21 failing which they will be taken to waive the right to file such application.

She fixed Sept 19 to hear the matter after being informed of the respondents' indication that they would be raising a preliminary objection to strike out the election petition.

Joniston, the returning officer and the Election Commission were named as the first, second and third respondent in the election petition.

Jo-Anna is represented by counsel Mary Florence Gomez, Edina Sung Burngoh and Hon Yi Vun, while Joniston is represented by Tengku Fuad and the RO and EC were represented by Japar, Muammar, Syarulnizam Salleh and Shahlan Jufri. - Jo Ann Mool
