Cop fined RM20,000 for harbouring Filipina

Kota Kinabalu: A 45-year-old police officer was fined RM20,000 or six months' jail for permitting an illegal Filipina to stay in his house.Sessions Court Judge Azreena Aziz made the order against Deputy Superintendent of Police Mohd Nizam Yang when his case was brought up for mitigation and sentencing, Tuesday.

Mohd Nizam was on July 20 this year, found guilty of allowing the 27-year-old woman, without any valid document, to stay at a house in Taman Ujana Kingfisher, Likas between April and November 2016.

The offence under Section 55E(1) of the Immigration Act 1959/1963 and punishable under Section 55E (2) of the same Act carries a jail term of up to a year, or a fine of between RM5,000 and RM30,000, or both, for each illegal immigrant involved, on conviction.

Azreena also ordered Mohd Nizam to pay the prosecution's cost of RM2,000 in default six months' jail.

The court also allowed Mohd Nizam's application for a stay of execution of the sentence with bail of RM10,000 and RM5,000 deposited in a local surety.

During mitigation, counsel Aida Jaafar Mad Arif, who acted together with counsel Hairul Vyron, asked for a bond of good behaviour saying that their client is still working but his salary had been suspended.

She added that if Mohd Nizam was given the bond, he would have an opportunity to continue his service because he was a very dedicated police officer and had received the Excellence Service Award as well as being honoured with Pingat Kedaulatan Negara in 2015 in respect of the Ops Daulat in the Lahad Datu intrusion 2013. Aida also told the court that Mohd Nizam was the sole breadwinner of his family.

However, Deputy Public Prosecutor Mohd Khairuddin Idris urged the court to impose a deterrent sentence on the grounds that it would not only serve as a lesson to Mohd Nizam but deter the public from committing the same.

He said if the court meted out a light sentence, the public would think that such offence can be solved with minimal fines.
