Jail, rotan for sodomising daughter, 8

Kota Kinabalu: A 46-year-old local who inserted his private part into his eight-year-old daughter's anus, was sentenced to 18 years' jail and ordered given two strokes of the cane.Sessions Court Judge Ainul Shahrin Mohamad handed the sentence to the man who changed his plea to guilty, Monday.The man had committed carnal intercourse against the order of nature on his daughter between 7am and 7.30am on Feb 13 this year at a house in Taman Kingfisher, near here.

The offence under Section 377C of the Penal Code provides for a jail term of up to 20 years and whipping, on conviction.During mitigation, the man who is currently serving sentence for taking syabu, asked for a light sentence as he has a family to look after.However, Deputy Public Prosecutor Rustam Sanip urged the court to impose a deterrent sentence on the grounds that there was evidence that the man had repeatedly committed the offence against the minor since she was six-year-old.Rustam stressed that as a father, the man should protect his daughter instead of committing the heinous crime.

The court heard that the incident came to light when the man's 16-year-old son saw his father committing the act against his sister at a room in their house.The son, who was also the complainant in this case, then asked the victim what the father had done to her and she said their father had did something (referring to the sodomy) on her.
