Jail, rotan for raping niece, 7

Kota Kinabalu: A 32-year-old local who raped his seven-year-old niece was sentenced to 30 years' jail and ordered given four strokes of the cane.

Sessions Court Judge Azreena Aziz handed the sentence to the man, who is a father of three, after he pleaded guilty to two counts against him, Friday.

On the first count, he was jailed 15 years plus two strokes of the cane for raping the minor at 12.30pm on July 23 this year behind a kitchen's door at a house in Sipitang.

On the second count, the man was jailed another 15 years and ordered to get two strokes of the cane for repeating the offence against the same minor at 7pm on the same day inside a toilet at the same house in Sipitang.

The offence under Section 376(2)(e) of the Penal Code carries a jail term of between 10 and 30 years, and whipping, on conviction.

Azreena ordered the man to serve the jail sentence consecutively.

The man was also ordered to pay a compensation of RM10,000 or six months' jail.

After completing his jail sentence, the man was ordered placed under police supervision for two years.

During mitigation, the man who was not represented, asked for a light sentence saying that he has family to look after.

However, Deputy Public Prosecutor Dinesh Raja urged the court to impose a deterrent sentence on the grounds that the man had raped the minor who is a schoolgirl. Dinesh added that such cases were very rampant and a heavy sentence should be imposed on the man as to give a lesson to the man and a warning to public at large.

The court heard that the victim's father had lodged a police report on July 25 claiming that his daughter was raped by his relative.

Further investigation showed that the man who is the girl's uncle had raped the minor twice.

The man was arrested on July 27 at a worker quarters in Sipitang. - Cynthia D Baga
