Harbouring Filipina: Cop is found guilty

Kota Kinabalu: A 45-year-old police officer was found guilty of permitting a Filipina to stay in his house.However, Sessions Court Judge Azreena Aziz deferred Deputy Superintendent of Police Mohd Nizam Yang's sentencing as the defence asked for postponement.

His sentencing was fixed for Aug 14 this year.

Mohd Nizam was previously stand on trial for trafficking the Filipina but the court discharged and acquitted him from the charge but found him guilty on the charge of allowing the illegal Filipina to remain at his premises.

He is accused of allowing the 27-year-old woman who has no valid document to stay at a house in Taman Ujana Kingfisher, Likas between April and November 2016.

The offence under Section 55E(1) of the Immigration Act 1959/1963 and punishable under Section 55E (2) of the same Act which carries a jail term of up to a year, or a fine of between RM5,000 and RM30,000, or both, for each illegal immigrant involved, on conviction.

For the original charge, Mohd Nizam was charged under Section 12 of the Anti-Trafficking-In Persons and Smuggling of the Migrants Act 2007 carries a jail term of up to 15 years and fine, on conviction.

Ten prosecution and two defence witnesses were called during the hearing.
