Farmer gets 13 years, rotan for raping stepdaughter

Kota Kinabalu: A 35-year-old farmer who was entrusted by his wife to take care of his stepdaughter while she was working in the peninsula, was jailed 13 years and ordered given a stroke of the cane for raping the girl.

Sessions Court Judge Noor Hafizah Mohd Salim meted out the sentenced to the man who changed his plea and pleaded guilty during the first day of trial, Thursday.

The man had raped the 14-year-old girl at 1am in November 2016 at a house in Tamparuli, Tuaran.

The offence under Section 376(2)(d) of the Penal Code carries a jail term of between eight and 30 years, and whipping, on conviction.

Counsel Henry Gudid, who defended the man, asked for leniency saying that his client had surrendered himself to the Tuaran police station and while he was under remand, he was remorseful as well as regretted the offence.

According to Henry, the man had carried out his responsibility by taking care of his stepchildren while his wife was working in Kuala Lumpur.

Henry also told the court that the man's wife also advised the man not to surrender even she knew the incident.

However, Deputy Public Prosecutor Dinesh Raja urged the court to impose a deterrent sentence as the man had committed a very serious and heinous crime against the girl.

The court heard that while the victim was sleeping, the man covered her mouth before raping her.

After raping her, the man warned the victim not to reveal the incident to anyone but the victim informed her 12-year-old sister and subsequently lodged a police report against the man.

Investigation revealed that the girl was the second child among three siblings and the man was entrusted to take of them since their mother was working in Kuala Lumpur. – Cynthia D Baga
