Smuggling drugs: Man, 22, ordered to enter defence

Kota Kinabalu: A 22-year-old man was ordered to enter his defence on a charge of trafficking 6,626gm of cannabis.High Court Judge Datuk Nurchaya Hj Arshad made the order to Mohd Izzan Azhar Abdullah ruling that the court was satisfied that the prosecution had established a prima facie case against him.She set March 29 for Mohd Izzan's defence.ADVERTISEMENT Mohd Izzan's counsel Zahir Shah informed the court that Mohd Izzan opted to give evidence by written statement and that he would be the sole defence witness.Mohd Izzan allegedly committed the offence at 10pm on Sept 14, 2016 in Kepayan.He faces the death penalty if convicted under Section 39B(1)(a) of the Dangerous Drugs Act 1952.The prosecution had called nine witnesses at the prosecution stage.ADVERTISEMENT Izzan was ordered be remanded further as the charge against him has no provision for bail.Deputy Public Prosecutor Gan Peng Kun prosecuted.

Bernard Peter pleaded guilty before Magistrate Cindy Mc Juce Balitus to committing the offence at 4.10pm on Jan 3 at a house in Kg Nambazan, Penampang.On the first count, Bernard was ordered to pay a fine of RM8,000 or eight months' jail for having 0.55gm syabu while on the second count, he was fined RM3,000 or six months jail for having 0.08gm of cannabis. - Jo Ann Mool
