Jeffrey sues activist over posting in FB

Kota Kinabalu: Bingkor Assemblyman Datuk Dr Jeffrey Kitingan has filed a civil suit against activist Zainnal Ajamain for allegedly posting defamatory remarks against him in Facebook.Dr Jeffrey, who heads Parti Solidariti (Star), named Facebook as the second defendant in his suit filed here on Wednesday.In his statement of claim, Dr Jeffrey said the first defendant had, on July 21, 2013, posted in his Facebook page a captioned picture of him slaughtering a rooster which allegedly happened at a Memorial Oath Stone.

Dr Jeffrey claimed that through the posting, the first defendant was insinuating that he (Dr Jeffrey) is a murderer, will commit genocide, a violent person, unfit for public office and a revengeful person.He said the first defendant had also insinuated that he was involved in cursing the people who established the Keningau Oath Stone; involved in a useless ritual notwithstanding that the ritual is part and parcel of the plaintiff's culture and race.Dr Jeffrey claimed that by reason of the postings of the first defendant on the social media pages, he has been brought into public scandal, odium and contempt or hatred, ridicule and the plaintiff has been hurt in his feelings and has suffered damage.He is seeking against the first defendant; damages, punitive damages and an injunction to restrain the first defendant whether by their servants or agents or otherwise from publishing the said or any similar libel upon him.

Dr Jeffrey is also seeking a mandatory injunction directing the first defendant to remove the libellous posting on Facebook.Meanwhile, against the second defendant, Dr Jeffrey is seeking an injunction to restrain the second defendant whether by their servants or agents or otherwise from publishing the said or any similar libel upon him.
