Kota Kinabalu: An 18-year-old was jailed 11 years and ordered to get a stroke of the cane for armed gang robbery.

Ismail Mohd Mansur pleaded guilty before Sessions Court Judge Noorhafizah Mohd Salim to robbing one Hairy Lounsin, a worker of the Orange outlet in Manggatal Plaza at 8.49pm on Dec 17, 2016.

Ismail together his co-accused Herman Nasir had used two axes in committing the offence and took away two boxes of cigarettes, two packets of crackers and a bottle of carbonate drink, all valued at RM80.

Herman was on Jan 12 this year sentenced to 10 years and ordered to receive two strokes of the cane after he admitted to the charge.

The offence under Section 395/397 of the Penal Code carries a jail term of up to 20 years and whipping, on conviction.

During mitigation, counsel Goldam Hamid who defended Ismail asked for a lenient sentence saying that there was no injury involved during the incident and Ismail used the axe just to threaten Hairy.

Goldam also informed the court that Ismail has a wife who will give birth their first child in March.

However, Deputy Public Prosecutor Dinesh Raja urged the court to impose a deterrent sentence as to give a lesson not only Ismail but public at large.

Ismail was ordered to serve the jail sentence from the date of his arrest on Jan 5 this year. - Cynthia D Baga
